These Terms and Conditions ("Terms") govern your use of joyofquilting.shop (the "Site"), operated by Shanna Gibbens dba Joy of Quilting ("we," "us," or "our"), with a physical location at 175 Nopal Street, Florence, Oregon 97439, and mailing address PO Box 211, Florence, OR 97439. By accessing or using the Site, making a purchase, or creating an account (if applicable), you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You must be at least 18 years old or the age of majority in your jurisdiction to use the Site. You agree to use the Site only for lawful purposes and in accordance with these Terms. We reserve the right to refuse service, terminate accounts, remove content, or cancel orders at our sole discretion.

2. Intellectual Property

All content on the Site, including text, images, logos, quilt designs, patterns, photos, and graphics, is the property of Shanna Gibbens dba Joy of Quilting or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

Handmade quilts and custom items sold on the Site are for personal, non-commercial use unless otherwise specified. Reselling our products or using our designs/patterns for commercial purposes without authorization is prohibited.

3. Product Information, Pricing, and Orders

We strive for accuracy in descriptions, images, and pricing, but errors may occur. We reserve the right to correct errors, update information, or cancel orders if pricing or availability is incorrect. All prices are in USD and subject to change. Taxes, shipping, and handling are calculated at checkout.

Orders are offers to purchase; we accept them by shipping confirmation. We may limit quantities or cancel orders for reasons including suspected fraud, errors, or other issues.

4. Payments

We accept Visa, MasterCard, Amex, Discover, JCB, Diner's Club and PayPal. You authorize us to charge your payment method for the total amount including taxes and shipping. All payments are final unless a refund is approved per our separate Returns and Refunds Policy.

5. Shipping and Delivery

Shipping times are estimates only and not guaranteed. We are not responsible for delays caused by carriers. Risk of loss or damage passes to you upon shipment. For any international orders (if offered), you are responsible for customs duties, taxes, and fees.

7. Warranties and Disclaimers

All products are provided "AS IS" except as expressly stated in writing. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Handmade quilts and items may have natural variations in fabric, stitching, or appearance.

8. Limitation of Liability

To the maximum extent permitted by law, Shanna Gibbens dba Joy of Quilting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, products, or services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the specific product(s) in question.

9. Indemnification

You agree to indemnify and hold harmless Shanna Gibbens dba Joy of Quilting, its owner, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site or products.

10. Prohibited Conduct

You agree not to: (a) use the Site for any illegal purpose; (b) infringe any intellectual property rights; (c) harass, threaten, or defame others; (d) introduce viruses, malware, or disruptive code; (e) attempt unauthorized access; or (f) engage in any activity that interferes with the Site's operation.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Lane County, Oregon.

12. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
